These Terms and Conditions of Sale (hereinafter "T&Cs") govern the use of the Tubify service, a SaaS (Software as a Service) YouTube performance tracking service accessible via tubify.yt. Any registration or use of the service implies unreserved acceptance of these T&Cs.
Access to the Tubify service requires registration with an email address and the creation of a user account. The user must verify their email address before being able to fully access the service. Access to features requires either a paid subscription or use of the free trial period.
Every new account has a 7-day free trial period, automatically activated upon registration. This period grants access to all service features without restriction and without requiring a credit card. At the end of the trial period, the user must subscribe to continue using the service.
The Tubify service is offered as a monthly subscription at 49€/month VAT included. In accordance with article 293 B of the French General Tax Code, the publisher benefits from the VAT base exemption: VAT not applicable, art. 293 B of the French Tax Code. The current price is shown on the pricing page. Payment is made via the secure Stripe platform. Billing is monthly and recurring: the subscription amount is automatically charged each month on the anniversary date of the subscription. No bank details are stored on our servers.
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium whose execution has begun with the consumer's prior express consent and for which they have waived their right of withdrawal. By accessing the service immediately after subscription, the user expressly waives their right of withdrawal. However, the user may cancel their subscription at any time in accordance with article 6 of these T&Cs.
The user may cancel their subscription at any time from their account area, without justification and without fees. Cancellation takes effect at the end of the current subscription period: the user retains access to the service until the expiration date of the already-paid period. No prorated refund will be made for the remaining period.
Tubify undertakes to provide a service in line with its description and to implement the means necessary for its proper functioning. However, Tubify cannot be held responsible for:
The Tubify service, its interface, design, source code and all its contents are the exclusive property of the publisher and are protected by intellectual property law. Any unauthorized reproduction, modification or use is strictly prohibited. The user retains full ownership of their personal data and the data they enter into the service.
The processing of users' personal data is detailed in our privacy policy, which forms an integral part of these T&Cs.
The publisher reserves the right to modify these T&Cs at any time. Users will be informed of any modification by email to the address associated with their account. Continued use of the service after notification constitutes acceptance of the new conditions.
These T&Cs are governed by French law. In case of dispute regarding the interpretation or execution of these T&Cs, the parties will endeavor to find an amicable solution. Failing this, the competent courts of Clermont-Ferrand shall have sole jurisdiction.
